Ty Cobb, a former White House attorney, shared his prediction on Wednesday regarding the ongoing case involving former President Trump’s mishandling of classified documents. Cobb suggested that the 11th Circuit Court might decide to remove Judge Aileen Cannon from the case.
During an interview on CNN’s “Erin Burnett OutFront,” Cobb referred to a recent filing by special counsel Jack Smith, indicating that Smith could escalate the matter to the 11th Circuit if Judge Cannon does not make a prompt ruling.
Cobb highlighted Cannon’s recent directive to both parties to propose jury instructions, which align closely with Trump’s interpretation of the Presidential Records Act (PRA). This directive came despite Cannon’s failure to address Trump’s earlier motion to dismiss the case based on PRA grounds.
In a strongly worded filing, Smith criticized Cannon for embracing a “fundamentally flawed legal premise” regarding the classified documents found at Trump’s Florida residence. He urged Cannon to make a timely ruling on the issue.
Cobb mentioned that the 11th Circuit has previously criticized Cannon’s handling of the case, which has experienced significant delays.

He expressed skepticism about attributing Cannon’s actions to mere inexperience or incompetence, suggesting instead that her bias is evident. Cobb argued that her actions create a perception of partiality, potentially disqualifying her from the case.
Trump faces charges under the Espionage Act for the intentional retention of national defense information and obstruction of justice for attempting to conceal the records from authorities.
