Staten Island man, 31, charged in holding cell assault found unfit to proceed

New York’s Staten Island. The court has remanded the man charged in the case to a mental health facility, months after police claim a 31-year-old man assaulted another inmate in a holding cell at the 120th Precinct stationhouse in St. George.

Because he was arrested for an unconnected incident that happened in the 123rd Precinct on October 23, Abanoub Michail of Rossville Avenue in Rossville was in the holding cell.

Records reveal that he is facing numerous accusations, including misdemeanor assault and harassment and felony assault in a correctional facility.

The court ordered Michail to have a psychiatric evaluation to ascertain whether he comprehended the charges against him and their possible repercussions after hearing arguments from both sides of the case.

Based on the findings of that examination, the court determined during a hearing on Thursday that the defendant was not suitable to continue.

A request for comment on Tuesday was not immediately answered by Michail’s lawyer.

The lawsuit was postponed until April 25 in order to reevaluate his mental health.

After months or years of medicine and therapy, people who are deemed unsuitable are frequently later cleared to continue.

The attack

According to the criminal complaint, Michail grabbed the victim and forced them against the bars of the holding cell.

After the attack, which happened on October 24 at 6:10 a.m., the victim required several stitches in his skull, according to the police.

According to the source, the victim was a 53-year-old guy.

The defendant, who is approximately 150 pounds in weight and 5 feet 8 inches tall, has entered a not guilty plea to all of the accusations.
